1. Acceptance of Terms

By accessing and using our artflyai service, you acknowledge that you have read, understood, and agree to be bound by these Terms and Conditions. If you do not agree with any part of these terms, please do not use our service.

2. Description of Service

artflyai provides search and research capabilities powered by artificial intelligence models. Our service is designed to help users find information, analyze data, and generate content based on user queries.

3. User Accounts

Some features of our service require you to create an account. You are responsible for maintaining the confidentiality of your account information and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account.

4. Payment and Subscription

Access to certain features of our service requires payment. By subscribing to our Pro plan, you agree to pay all fees in accordance with the billing terms in effect at the time of your subscription. You may cancel your subscription at any time, but we do not provide refunds for unused portions of your subscription period.

We may also offer one-time purchases as an alternative to a subscription. A one-time purchase applies only to a single video created with the Pro feature and entitles you to a limited number of downloads of that specific video (currently five). It does not grant a subscription, credits, or access to any other video or feature. Prices and download limits are set at the time of purchase and may change from time to time. One-time purchases are non-transferable and, except where required by applicable law, non-refundable.

5. Credit System

Our service operates on a credit-based system where credits are consumed when using AI features. Key points about our credit system:

• Credits are deducted based on the AI operations performed (image generation, video creation, editing, etc.)
• Different features consume different amounts of credits based on computational complexity
• Credits cannot be refunded once consumed or used for AI operations
• Purchased credits do not expire and remain in your account until used
• We reserve the right to modify the credit system, including credit pricing and consumption rates, with prior notice
• Credit balances are non-transferable between accounts

6. User Conduct

You agree not to use our service to:

• Violate any applicable laws or regulations
• Infringe on the rights of others
• Generate harmful, abusive, or illegal content
• Attempt to gain unauthorized access to our systems
• Interfere with the proper functioning of the service

7. Content Upload and User Responsibilities

By uploading content, you confirm that:

• Your file complies with our Terms of Use and does not infringe any third-party rights.
• You own all necessary rights and permissions to use the content.
• The content does not include illegal, harmful, or sensitive material.
• You grant the app permission to process, edit, or convert the file as required to provide the service.

8. Intellectual Property

All content and technology used to provide our service, including but not limited to text, graphics, logos, and software, are the property of artflyai or our licensors and are protected by copyright, trademark, and other intellectual property laws.

9. Content Generated by AI

Content generated by our AI models is provided for informational purposes only. Important considerations:

• AI technology can make mistakes, produce inaccurate results, or generate unexpected outputs
• We do not guarantee the accuracy, completeness, quality, or reliability of AI-generated content
• You are solely responsible for evaluating, verifying, and using AI-generated content
• AI outputs are not exclusive: similar prompts or inputs may produce identical or similar outputs for other users, and we do not guarantee the uniqueness or exclusivity of any generated content
• Generation requests may be declined or blocked by automated content-safety systems — ours or those of the third-party AI providers that power the service — and such decisions may not be reversible
• We do not provide refunds for AI errors, including but not limited to incorrect outputs, failed generations, or unsatisfactory results
• Credits consumed during AI operations that result in errors or unsatisfactory outputs are non-refundable

10. Ownership of Generated Videos and Showcase License

• As between you and us, you own the videos you generate with the service, subject to these terms and to the rights of the underlying AI-model providers.
• You grant us a limited, non-exclusive, revocable license to display videos generated on the service in our public gallery, website, and marketing materials.
• This showcase license is revocable: you may opt out at any time by emailing info@artflyai.com, and we will remove the relevant videos from our showcase within 14 days.
• We do not sell your content and we do not sublicense it to third parties.

11. Uploaded Photos of People

• If you upload a photo or video that includes a person (including yourself), it is processed solely to generate the video you requested.
• You confirm that you have the consent of every person depicted in the content you upload.
• We do not create, store, or retain biometric identifiers from uploaded media, and we do not use uploaded photos of people to train AI models.

12. AI Outputs and Third-Party Intellectual Property

• Videos are generated by third-party AI models. While these models are designed to produce original content, we cannot and do not warrant that generated content will not resemble, reproduce, or infringe existing copyrighted works, trademarks, likenesses, or other third-party rights.
• You are solely responsible for reviewing generated content before using it, and for your use and publication of it, including any commercial use, advertising, or distribution.
• To the maximum extent permitted by law, we shall not be liable for any third-party claim — including copyright, trademark, or right-of-publicity claims — arising from your use or publication of generated content.
• You agree to indemnify and hold us harmless from any claims, damages, or expenses arising from content you upload or from your use or publication of content generated through the service.

13. Published Websites and Hosted Content

The website builder lets you create and publish a website served from our domain (for example, artflyai.com/s/your-site). For every website you publish:

• All content on your published website — text, photos, videos, links, and anything submitted through it — is your content and your sole responsibility. We act only as a passive host of pages you create and publish.
• You confirm that you own, or hold a valid license for, every photo, video, and other asset you upload or display. Publishing content copied from search engines, other websites, or any source you do not have rights to is prohibited.
• We have no obligation to pre-screen or monitor published websites, but we reserve the right to unpublish, remove, or block any page at any time, at our sole discretion and without prior notice — including for suspected copyright or trademark infringement, unlawful, harmful, misleading, or deceptive content, spam, or link schemes.
• Copyright complaints: if you believe a page published through our service infringes your rights, follow our Copyright & DMCA Policy or contact us at info@artflyai.com (every published page also carries a Report link). We remove or disable access to infringing material expeditiously, and we terminate the accounts of repeat infringers.
• Details submitted by your visitors through your website's contact form are delivered to you, and you are solely responsible for handling them lawfully, including any consent, privacy, and marketing-communication requirements that apply to you.
• Published pages may carry a small "Made with ArtFlyAI" attribution and a Report link. Pages are served with caching and their availability is provided "as is", without uptime guarantees.
• The indemnification in Section 12 applies equally to websites you publish: you agree to indemnify and hold us harmless from any claim arising out of your published website or its content.

14. Refund Policy

Our refund policy is as follows:

• We do not provide refunds for AI errors, incorrect outputs, or unsatisfactory AI-generated results
• Credits consumed during usage are non-refundable once the AI operation has been initiated
• Refund requests must be submitted through our support system at info@artflyai.com
• All refund requests will be reviewed on a case-by-case basis within 48 hours of submission
• Approved refunds will be processed using the original payment method within 5-10 business days
• We reserve the right to deny refund requests that do not meet our refund criteria

15. Limitation of Liability

Our service is provided "as is" without any warranties. We shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or use, arising out of or in connection with your use of our service.

16. Modifications to Terms

We reserve the right to modify these Terms and Conditions at any time. We will notify users of significant changes by updating the date at the top of these terms and/or by providing notification through our service. Your continued use of our service after such modifications constitutes your acceptance of the revised terms.

17. Termination

We reserve the right to terminate or suspend your account and access to our service at our sole discretion, without notice, for conduct that we believe violates these Terms and Conditions or is harmful to other users, us, or third parties, or for any other reason.

18. Governing Law

These Terms and Conditions shall be governed by and construed in accordance with the laws of Israel Tel-Aviv, without regard to its conflict of law principles.
